PRIVACY POLICY
This section informs you of our policies regarding the collection, use, and disclosure of personal data we receive from you as a potential client interested to order our services.
The Controller and the data processor(s) shall handle all personal data in a confidential manner and observe the prevailing data protection laws and regulations, in particular, Act CXII of 2011 on Informational Self-Determination and Freedom of Information, Act VI of 1998 on the ratification of Strasbourg Convention of 28 January 1981 for the Protection of Individuals with regard to Automatic Processing of Personal Data and Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation - GDPR).

(hereinafter referred to as the ‘Controller’ or ‘We’) in a confidential manner, in compliance with the provisions herein and the prevailing privacy laws.
In order to ensure the safe processing of data, the Controller shall take all IT and other measures related to the storage, processing, and transmission of data. The Controller shall take the expectable measures to protect the personal data processed by it against unauthorized use, alteration, disclosure, deletion, damage, or destruction and to ensure the technical conditions required thereto.

When contacting us, the client (or the client’s legal representative) supplies his/her personal data for the purposes to order our services or for future business cooperation. Institute for vertical transportation Ltd. processes your personal data to deliver the ordered services. Below is an overview of the personal data we process:

Important - Institute for vertical transportation Ltd. does not verify any of the personal data provided. The person providing supplying such data shall be fully liable for their accuracy.
The persons entitled to have access to data
The data provided by you will be available only for those employees of the Controller, the performance of whose tasks and duties require the knowledge of such data mainly in order to contact you for further cooperation or to deliver the services ordered by you.
How we protect personal data
Institute for vertical transportation Ltd. takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. The legal basis of data processing: the consent of the data subject
Storage period of personal data
Institute for vertical transportation Ltd. does not store your personal data for longer than is strictly necessary to realize the purposes for which your data is collected, but no longer than 5 years.
Sharing personal data with third parties
Institute for vertical transportation Ltd. will not provide your information to third parties and will only provide this information if this is necessary for the execution of our agreement with you or to comply with a legal obligation. We provide data to any official authorities (in case such authorities have clearly indicated the exact purpose, and the scope of data required), if this is necessary to fulfil the purposes indicated for such request.
With companies that process your data in our assignment, we conclude a processor agreement to ensure the same level of security and confidentiality of your data.
However please note that this website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.
Your rights, as a data subject
The aim of this information is to provide proper information on facts and particulars related to data processing for the data subjects (hereinafter referred to as the ‘Data Subject’).
You are entitled to obtain confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and to the following information:
the purposes of data processing:
categories of the affected personal data;
the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations;
where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
the existence of the right to request from the Controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
the right to lodge a complaint with a supervisory authority;
the existence of automated decision-making, including profiling and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.
Upon request, the Controller shall provide you with a copy of the personal data undergoing processing.
You may request at any time the correction or supplementation of erroneous personal data; the Controller shall take the requested measures without undue delay.
You are entitled to withdraw your consent at any time.
The consent may be withdrawn by sending your request for the withdrawal of your consent to the Controller, as described herein.
The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
In case you withdraw your consent, the Controller shall delete your personal data from their database within 30 days.
Upon the request of the Data Subject, the Controller shall delete the personal data concerning him or her, without undue delay, if
the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
the Data Subject withdraws consent on which the processing is based, and there is no other legal ground for the processing;
the processing of the personal data is for direct marketing purposes, and the Data Subject objects to the processing, and there are no overriding legitimate grounds for the processing;
the personal data have been unlawfully processed; or
the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the Controller are subject;
The above provisions shall not apply to the extent that processing is necessary:
(a) for exercising the right of freedom of expression and information;
(b) for compliance with a legal obligation which requires processing by Union or Member State law to which the Controller are subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller;
(c) for reasons of public interest in the area of public health;
(d) for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, in so far as the right to deletion is likely to render impossible or seriously impair the achievement of the objectives of that processing; or
(e) for the establishment, exercise, or defense of legal claims.
The Controller shall restrict data processing upon the request of the Data Subject, if
the accuracy of the personal data is contested by the Data Subject, for a period enabling the Controller to verify the accuracy of the personal data;
the processing is unlawful, and the Data Subject opposes the erasure of the personal data and requests the restriction of their use instead;
the Controller no longer need the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defense of legal claims; or
if the processing of personal data takes place for direct marketing purposes and the Data Subject has objected to the processing; in this case, the restriction shall be valid as long as it is verified whether the legitimate grounds of the Controller override those of the data subject.
Where processing has been restricted according to the above, such personal data shall, with the exception of storage, only be processed with the data subject's consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the Union or of a Member State. A data subject, who has obtained restriction of processing pursuant to the above provisions, shall be informed by the Controller before the restriction of processing is lifted.
In addition to the above, the Data Subject shall have the right to receive the personal data concerning him or her, which he or she has provided to the Controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another Controller without hindrance from the Controller to which the personal data have been provided.

For the sake of identification, correct and specific personal data shall be provided.
The Controller shall notify the Data Subject of the measures taken upon the request for exercising his/her rights without undue delay, but in any case, within 30 days of the receipt of the request.
Where the Data Subject makes the request by electronic form means, the information shall be provided by electronic means where possible, unless otherwise requested by the Data Subject.
The correction, restriction, and deletion of data shall be reported by the Controller to the concerned Data Subject and those, to whom the affected data were previously transmitted for data processing purposes.
The Data Subject shall have the right to object, on grounds relating to his or her particular situation, at any time to the processing of personal data concerning him or her, which is based on legitimate interest. In such a case, the Controllers may no longer process the personal data unless the Controllers demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of legal claims.
The Controllers shall suspend the data processing and examine the objection within the shortest possible deadline, but within maximum 30 days and inform the requesting party of the result thereof in writing. If the objection is well-grounded, the Controllers shall terminate the processing (including any further collection or transmission of data) and shall restrict the affected data. Furthermore, the Controllers shall notify of the objection and the measures are taken in response thereto those, to whom the personal data affected by the objection were transmitted previously; these recipients shall also provide for the enforcement of the right to object.
If the Controllers do not take action on the request of the Data Subject, the Controllers shall inform the data subject without delay and at the latest within 30 days of receipt of the request of the reasons for not taking action and on the possibility of lodging a complaint with a supervisory authority and seeking a judicial remedy.
View, modify or delete data
You have the right to view, correct, or delete your personal data. You also have the right to withdraw your consent to the data processing or to object to the processing of your personal data by Institute for vertical transportation Ltd. and you have the right to data portability. This means that you can submit a request to us to send the personal data that we have available to you or another organization mentioned by you in a computer file.
You can send a request for access, correction, deletion, data transfer of your personal data, or request for cancellation of your consent or objection to the processing of your personal data to info@belistria.eu.
We respond as quickly as possible, but within 8 days, at your request.
In case of infringement of the above-mentioned rights, you may turn to the Information Commissioner’s Office (ICO). You are authorized to file a complaint with the supervisory body for the protection of privacy and personal data. Anyone can access this website (without a need for identification, or to supply personal data), and can gain information from there, or from any related websites, freely and without any restrictions applied. However, the website automatically collects general (not tied to the individual visitors’ person) information about the website visitors, in an unrestricted manner. Nonetheless, no such data allows the website operator to gain any personal information about the visitors.

Bel’Istria provides an online service (www.belistria.eu) through which you can make your reservation.

Reservations can also be made by phone or email.

Personal data provided by you on www.belistria.eu is processed in a confidential manner, in compliance with the prevailing privacy laws.

The client is responsible for all correct travel details and cannot get a refund in case of incorrect data. The person making the reservation must be of legal age (over 18 years of age) and is responsible for personal information provided at the time of booking.

When booking, please provide us with additional passenger requirements (music, newspapers, special drinks) and/or additional vehicle equipment (child seats, etc.)

The reservation must be made at least 24 hours before your departure.

Once you have made a pre-reservation it will be automatically confirmed and we will send you a confirmation of availability with the price by e-mail or similar.

If your reservation is not confirmed by Bel'Istria, we cannot guarantee that you will receive the requested service. We will not be responsible for any losses or additional costs incurred.

Cancelation policy: If the service is cancelled:

24 hours or more prior to the pick-up, there are NO cancellation fees.

24 to 8 hours prior to the pick-up time, cancellation fee is 50% of the agreed booking amount
-
less than 8 hours prior to the pick-up time, 100% charge is to be applied.

Prices of services are agreed or confirmed in advance.

Pick up instructions: Our driver/chauffer/pilot would meet and greet the passenger(s) at the confirmed pick-up location (airport arrival terminal, at the hotel lobby or any similar place), holding a name board sign with the distinctive logo and would be ready to assist with luggage.

Waiting time: The price includes 15 minutes waiting time after the defined pick-up time or 45 minutes waiting time after the plane landing. Thereafter the additional waiting time is charged in the amount of 100% of the hourly rate.

Services are performed with at least one passenger from the departure (pick-up) point to the pre-agreed place of arrival.

Minors may travel only accompanied by an adult or if carrying a written statement from a parent or guardian.

The luggage mentioned comprises 1 large suitcase and 1 small handbag per person. If you have a larger amount of luggage, let us know in advance. Additional quantity as well as other luggage is free of charge.

Bel’Istria does not take responsibility if you are late for your destination due to road conditions, traffic jams, missed flights, boats, trains, buses and / or other unfavorable driving conditions.

Bel’Istria does not accept any responsibility in case of giving wrong information by the client which will result in a delay to the destination or the departure point.

Drivers have the right to refuse boarding if the client is drunk, under the influence of narcotics or in case there is a possibility of endangering themselves and other passengers during transport. There is no refund for such cases.

Smoking in vehicles is prohibited.

The driver is not obliged to stop the vehicle in places that he believes could endanger the health or lives of passengers.

In case of damage to the vehicle, the client is obliged to compensate for the damage.

Bel’Istria provides an online service (www.belistria.eu) through which you can make your reservation and pre-booking. Client may book the tour organised by Bel'Istria by email directly or with other authorised agents. Reservations and bookings can also be made by phone.

PAYMENT
In regular conditions, our standard procedure is deposit payment upon itinerary agreement. Client’s deposit is due immediately on booking confirmation (30 – 50%, depending on the program). The balance payment is due about a month before your arrival. For payments, we accept wire transfer and major credit cards (Visa, Amex, Mastercard) through our secure payment gateways (on-site only). If you are booking less than 4 weeks before your arrival, payment in full is required. In case of major changes after the final program has been confirmed, there will be a 300 € surcharge. After receiving the deposit, we will issue an official booking confirmation. Payment of the deposit constitutes your acceptance of the terms and conditions.
ADDITIONAL CHARGES
Bel'Istria proposes not to change your existing and confirmed itinerary during the season (from April to November) in order not to compromise the quality of the services. Any major changes (change of dates, booked hotels/services…) to the confirmed program within 30 days prior to the arrival are subject to availability. Any such changes are subject to 300 € administrative fee.
Agent support via email is available between 09:00 am and 5:00 pm. Use of this service outside of working hours might not be fully reachable since agents check their emails occasionally.
In case of any emergency or last minute update, please call agent directly on mobile phone stated in your info document.
TRAVEL INSURANCE
Protect yourself and your investment against the unexpected! We strongly recommend purchasing affordable, comprehensive travel insurance protection once your trip is booked. The summary of benefits to name a few include trip cancellation, trip interruption, medical, lost/delayed baggage, and emergency evacuation. Details on this plan will be provided upon receipt of deposit or upon request.
PRICING, INCLUSIONS/EXCLUSIONS
Prices do not include tips/gratuities to chauffeurs or local guides; entrance tickets to museums, some churches, national parks etc. unless noted, international flights, optional tours, baggage and personal insurance; any items of a personal nature; and any beverages or food not specifically listed under “The Program Price Includes” at the back of your confirmed program.
Tour quotes do not include airfare to/from the trip start point unless noted in the itinerary.
Bel’Istria has the right to increase the price of the Travel if the price increase is solely the direct consequence of the change of: a) the cost of transport of passengers arising from fuel costs or other energy sources, b) the amount of tax or fee for Travel services covered by a contract by authorities or entities not included in the execution of an Travel, including tourist taxes, landing fees or fees for embarkation or disembarkation at ports and airports or c) foreign exchange rates relevant to the Travel arrangement.
An increase in the price, regardless of its size, is only possible if Bel’Istria inform the Client in writing, in clear and understandable manner, with the explanation of this increase and calculation, but no later than 20 days before the beginning of the Travel.
CANCELLATION POLICY
Any cancellation of the service must be notified to Bel'Istria in written and it is subjected to cancellation fees as follows:
60 days or more prior to arrival will receive a full refund minus a € 200 per person administrative fee and any non-refundable paid fees (e.g. non-refundable airfare, cruise, charter or hotel deposits).
59 – 30 days will be subject to loss of 50% of program price.
29 days or less will be subject to 100% of program price.
Any major changes (change of dates, booked hotels/services) to the confirmed program within 30 days prior to the arrival are subject to availability. Any such changes are subject to 300 € administrative fee.
Bel’Istria reserves the right to change/adjust and notify client on the cancellation policy change during the booking process according to the type of product offered (i.e., Exclusive property use, yacht rental, etc)
In addition, all refunds are subject to the refund policies of each hotel, boat and other vendors, some of which have specific cancellation policies where funds paid are non-refundable. Accordingly, the amount refunded to Client may be further reduced as a result of these policies. Client will be notified in time!
The Bel’Istria cannot accept liability and will not be able to refund in case of force majeure – means any cause directly attributable to acts, events, non-happenings, omissions, accidents or Acts of God beyond the reasonable control of the Bel’Istria or the Client including, but not limited to; terrorist actions, sanitary disorders, natural disaster, disease outbreak, lock-outs or other labor disputes, civil commotion, riots, blockade, invasion, war, fire, explosion, sabotage, storm, collision, grounding, fog, new governmental act or regulation, major mechanical or electrical breakdown beyond the staff’s control and not caused by Bel’Istria negligence, traffic accidents, sudden and unusual traffic jams, intervention of competent authorities, sudden changes of public transport timetables, delays of airlines and other means of transportation, unfavorable weather conditions and the like.
If, during or after the booking of a tour, a Client anticipates they may have to cancel the tour due to unexpected obstacles or any reason, in order to avoid the costs of the tour cancellation stated in the part of these Terms and Conditions titled “Cancellation Policy”, they can pay the insurance from the risk of cancellation with the preferred insurance company directly.
Bel’Istria strongly advises to all its clients to purchase comprehensive insurance policies from the preferred insurance company in case of expiration, cancellation or interruption of travel.
CANCELLATION BY BEL’ISTRIA
In case of extraordinary circumstances arise that cannot be avoided or eliminated (war, riots, strike, terrorist actions, sanitary disorders, natural disaster, disease outbreak, traffic accidents, sudden and unusual traffic jams, intervention of competent authorities, sudden changes of public transport timetables, delays of airlines and other means of transportation, unfavorable weather conditions and the like), which – had they occurred at the time of closing the Tour – would have been a justified reason for Bel’Istria not to act as agent for tourist services, Bel’Istria may propose a change to the services booked or cancel the services booked (altogether or in part) with notifying Client and acting in his/her biggest interest.
Bel’Istria can cancel the Tour and claim compensation from a traveler who does not comply with the Terms and conditions, primarily if the traveler intentionally provided inaccurate information on the travelers and their age or if changes occurred during the course of the tour of which the traveler has not notified Bel’Istria.
Bel’Istria bears no responsibility if individual activities and services that depend on the weather conditions (low sea temperature, precipitation and the like) cannot be realized in line with the travelers’ expectations.
NOTICE ON FILING CLIENT’S COMPLAINTS
Client has a right to complain to the unfulfilled contractual services. He is required to file a written complaint to the Bel’Istria, and maximum up to seven days of the tour. Complaints filed after the expiration of seven days will not be taken into consideration. Pursuant to the provisions of Articles 6 and 21 of the Tourism Supply Act (OG 130/17) as well as the provisions of Art. 10 of the Consumer Protection Act (OG 41/14, 110/15) Clients are entitled to submit complaints about the quality of our services in writing or in person at the following address: Institut za vertikalni transport d.o.o.; Vrsarski prilaz 2, 52100 Pula or info@belistria.eu
Bel’Istria will immediately acknowledge receipt of your complaint, and immediately and at the latest within 15 days of receiving the receipt, respond. The mandatory information that are required for filling the complaint is: the name and surname of the person submitting the complaint and the exact address for the submission of the response. The Client is obliged to explain the reasons for filing the complaint and to present the relevant evidence.
Bel’Istria will only deal with fully-filed complaints and will keep a written record of the complaints, filed at least one year from the date of their receipt.
Until the Organizer makes a decision on the complaint, the Client negates the mediation of any other institution or competent authority, the right to file a lawsuit and to provide information to third parties or public media.
OTHER
The client is responsible for all correct travel details and cannot get a refund in case of incorrect data. The person making the reservation must be of legal age (over 18 years of age) and is responsible for personal information provided at the time of booking.
